General Terms and Conditions

City Hostel Fürth

I. Scope

1. These General Terms and Conditions (GTC) apply to all contracts for the letting of rooms and beds at City Hostel Fürth for accommodation purposes, as well as to all related services and supplies.

2. These include, in particular:

o Overnight stays

o Long-term stays

o Accommodation for workers

o Additional services (e.g. breakfast, parking, laundry service)

o Bookings made via direct sales channels and online booking platforms.

3. Any deviating terms and conditions of the guest shall only apply if the hostel has expressly agreed to their validity in writing.

II. Conclusion of the Contract

1. The accommodation contract is concluded upon acceptance of the booking by the hostel.

2. Bookings may be made:

o via the website,

o by telephone,

o by email,

o in person,

o via booking platforms (e.g. Booking.com, Hostelworld or other distribution partners).

3. For bookings made via third-party booking platforms, their terms and conditions of use shall apply in addition, provided they do not conflict with German law.

4. The contracting party is exclusively the guest making the booking. This guest is liable for any damage culpably caused by them or their fellow travellers in accordance with the statutory provisions (Section 278 of the German Civil Code (BGB)).

5. Minors may only stay overnight if accompanied by a parent or legal guardian or with a written declaration of consent.

III. Services

1. The hostel will only provide the room category booked.

2. Guests are not entitled to a specific room, bed or Momoshi Art Room.

3. In shared rooms, guests are not entitled to a lower or upper bunk bed.

4. The hostel is entitled to allocate a different room within the same category.

5. Communal facilities such as the kitchen, showers or common rooms may only be used in accordance with the house rules.

IV. Prices and Terms of Payment

1. The prices shown at the time of booking apply.

2. All prices include statutory VAT.

3. Additional services will be charged separately.

4. The hostel is entitled to

o require advance payments,

o pre-authorise credit cards,

o collect the full amount prior to arrival,

o require security deposits.

5. If payment is not successfully processed, the hostel may cancel the booking.

6. For bookings made via booking platforms, payment processing is carried out in accordance with the respective platform’s terms and conditions.

V. Cancellation Policy

The terms and conditions of the respective rate booked apply.

Flexible Rate – 24 hours

• Free cancellation up to 24 hours before arrival

• After that: 100% of the total price

• No-show: 100%

Flexible Rate – 7 days

• Free cancellation up to 7 days before arrival

• After that: 80%

• No-show: 100%

Flexible Rate – 14 days

• Free cancellation up to 14 days before arrival

• After that: 50%

• No-show: 100%

Non-refundable Rate

• 100% of the total price from the time of booking

• No refund

Early Bird Rate

• Paid in full in advance

• No free cancellation

• No rebooking

Weekly and monthly rates

• Separate terms and conditions as per the booking confirmation; early departure does not entitle the guest to a refund of fees already due, insofar as permitted by law

Goodwill policy: Free cancellation within 24 hours of booking, provided there are more than 24 hours between booking and arrival.

The guest reserves the right to prove that no loss, or a significantly lower loss, has been incurred. This right to provide evidence applies to all rate categories under this Section V, including the ‘Non-refundable Rate’ and the ‘Early Bird Rate’, insofar as these are economically equivalent to a cancellation fee.

VI. Termination by the Hostel

The Hostel may terminate the contract if

• there are circumstances of force majeure,

• incorrect information has been provided,

• payment terms are not met,

• the guest breaches statutory provisions,

• the proper running of the hostel is jeopardised,

• other guests are significantly disturbed.

Further claims for damages by the guest are excluded in such cases. This does not apply where the exclusion is based on wilful misconduct or gross negligence on the part of the hostel, or where damage results from injury to life, limb or health.

VII. Check-in / Check-out

1. The check-in and check-out times are set out in the booking confirmation.

2. A valid official photo ID is required for check-in.

3. The hostel may offer a digital online check-in service.

4. The guest is obliged to provide all legally required registration details completely and truthfully.

5. In the event of a late departure, an additional night’s accommodation charge may be applied.

VIII. Use of Rooms

1. Rooms may only be used by the persons for whom the booking was made.

2. Visitors may only stay in the guest rooms with the hostel’s consent.

3. Subletting is not permitted.

4. Commercial activities within the hostel require prior consent.

IX. Shared Rooms

1. There is no entitlement to exclusive use of shared rooms.

2. Bed allocations may be changed at any time.

3. There is no entitlement to shared accommodation for several people travelling together, unless this has been expressly confirmed.

X. Female Dorms

Female Dorms are reserved exclusively for female guests.

Should an unauthorised booking be made in error, the hostel may offer equivalent alternative accommodation or cancel the booking.

XI. Long-term stays

For long-term guests, the individually agreed terms and conditions of the contract shall apply in addition.

Weekly bed linen changes and agreed cleaning services shall be provided in accordance with the booking confirmation.

XII. House Rules

All guests undertake to comply with the house rules.

In particular, the following apply:

• No smoking anywhere in the building

• No open flames

• No dangerous objects

• Observance of quiet hours

• Treating other guests with respect

• Keeping communal areas clean

In the event of serious breaches of the house rules, the hostel may expel the guest from the premises. Accommodation fees already paid but not yet utilised will be refunded, less any damages incurred by the hostel. The guest reserves the right to prove that no damage, or only significantly less damage, has been incurred.

XIII. Key Cards

Guests will be charged the replacement cost of any lost or damaged RFID key cards. The guest reserves the right to prove that no damage, or only significantly less damage, has been incurred.

XIV. Liability of the Hostel

1. The hostel is liable in accordance with statutory provisions for damage resulting from injury to life, limb or health.

2. In all other respects, the hostel shall only be liable in cases of wilful misconduct and gross negligence, as well as in the event of a breach of material contractual obligations. In cases of slight negligence, liability is limited to the foreseeable damage typical for this type of contract.

3. The statutory liability provisions (§§ 701 et seq. BGB) apply to items brought onto the premises.

4. No security is provided for vehicles in car parks.

5. Subject to the liability provisions in Clause XIV.2, the hostel does not guarantee the uninterrupted availability at all times of Wi-Fi, the internet, electricity, water or other technical facilities.

XV. Guest’s Liability

The guest is liable for all damage culpably caused by them or their travelling companions in accordance with the statutory provisions (Section 278 of the German Civil Code (BGB)).

Any damage discovered must be reported to reception immediately.

XVI. Data Protection

Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and the applicable data protection laws.

XVII. Final Provisions

1. German law shall apply. In the case of consumers who have their habitual residence in another country, the application of mandatory consumer protection provisions of that country pursuant to Article 6(2) of the Rome I Regulation remains unaffected.

2. Should any provision of these General Terms and Conditions be or become invalid, in whole or in part, this shall not affect the validity of the remaining provisions.

3. Statutory consumer rights remain unaffected.
